Affiliate Agreement

Hi friend, and welcome. This page covers two sides of the same coin:

• Part One – when we recommend things (books, Audible titles and other products) and may earn a small commission, including through the Amazon Associates Program.
• Part Two – when you recommend us, as an It’s Me by Design affiliate.

It sits alongside our Terms & Conditions, Privacy Policy and Disclaimer, which cover everything from cookies to copyright.

Part One: When We Recommend Things (Our Affiliate Disclosure)

Some of the links on our website, in our programs and lessons, in our emails and on our social media are affiliate links. That means if you click one and buy something, we may earn a small commission, at no extra cost to you.

As an Amazon Associate I earn from qualifying purchases. It’s Me by Design is a participant in the Amazon Associates Program, an affiliate advertising program that lets us earn fees by linking to Amazon (including Audible) products.

A few things we want you to know:

• We only recommend books, tools and products we genuinely rate and think could help. A commission never decides what we recommend.
• Prices, availability, delivery and returns are set by the retailer, not by us. Your purchase is between you and them, under their terms.
• A recommendation is general information, not legal, financial or professional advice for your situation.
• When you click an affiliate link, the retailer may use cookies to record that you came from us. Our Privacy Policy explains more about cookies and third parties.

Part Two: Becoming an It’s Me by Design Affiliate

Love what we do and want to share it? We’d love that too. This part is a legally binding agreement (the “Agreement”) between you (the “Affiliate” or “you”) and Hello Mojo Pty Ltd ABN 67 615 177 104, trading as It’s Me by Design (“It’s Me by Design”, “we”, “us” or “our”).

By applying for, or taking part in, our affiliate program, you agree to everything below. Let’s dive in.

1. The Basics (Let’s Make It Official)

To be an It’s Me by Design affiliate, you must:

• Be 18 or over and legally able to enter into a contract.
• Promote our products in a respectful, transparent and non-spammy way.
• Only use your unique affiliate link to refer people to us.

We may approve or decline any application for any reason, though we’d love to work with people who are a values fit.

2. What You’re Promoting

This Agreement covers referrals of It’s Me by Design digital products, including our programs, courses, ebooks, checklists, templates, memberships and workshops (such as Uncouple by Design and Blueprint by Design, and future offerings), when they’re bought through our own checkout on itsmebydesign.com or members.itsmebydesign.com.

It doesn’t cover physical products, coaching or one-on-one services, or third-party offers (including the Amazon products in Part One), unless we agree otherwise in writing.

3. The Commission Breakdown (aka How You Get Paid)

• You earn a commission on the net sale price of eligible products bought through your affiliate link. “Net” means after GST, discounts, refunds, chargebacks and payment processing fees.
• Your commission rate, and how long your link keeps tracking after someone clicks it, are shown in your affiliate dashboard or welcome email. We may change rates for future sales with notice, but never for sales you’ve already earned.
• A sale is credited to you when our affiliate platform tracks it to your link. Tracking relies on cookies, so we can’t credit sales we can’t see (for example, if someone clears their cookies or buys on another device). Our platform’s records are final.
• Commissions are paid by the 15th of the month after the sale, or once the product’s refund period has ended, if that’s later.
• We pay by bank transfer or PayPal, whichever you prefer. We’ll ask for your details when you join.
• You’re responsible for any tax on your commissions. If you’re registered for GST, let us know when you join.
• You can see your tracked sales in our affiliate platform, so you can keep tabs on how things are going.

4. Promoting the Right Way

Many of the people we serve are going through big, tender life changes. Please promote us the way we’d promote ourselves: with honesty and care. You agree to:

• Promote our products truthfully, and never promise results, legal outcomes or income.
• Clearly disclose that you use affiliate links, in line with Australian Consumer Law, ACCC guidance and any advertising or influencer codes that apply to you (and the rules of your own country, if you’re outside Australia).
• Not pretend to be us. You’re amazing, but you’re not Annie.
• Not give legal, financial or other professional advice on our behalf.
• Not use fear, pressure or someone’s hardship to make a sale.
• Not send spam or unsolicited messages, and follow the Spam Act 2003 (Cth) and any other email and messaging laws that apply to you.
• Not bid on our brand names (It’s Me by Design, Uncouple by Design, Blueprint by Design, Hello Mojo, Annie Monroe or similar) in paid search or social ads, or use them in domain names, usernames or page names.
• Not list our products on coupon, deal or cashback sites unless we’ve said yes in writing.
• Not buy through your own link, or earn commission on purchases by your own household.
• Follow any brand guidelines or promotional materials we give you, and not change our logos or content.
• Keep your affiliate login secure and confidential.

5. Refunds, Cancellations + Chargebacks

If a customer who used your link cancels or gets a refund, the commission for that sale is cancelled (or deducted from a future payout if it’s already been paid). If there’s a chargeback or dispute, we may adjust your commission to match.

6. Customer Privacy

Customers who buy through your link are our customers, and we look after their information under our Privacy Policy. We won’t share their personal details with you. If you ever handle personal information in connection with this program, you agree to protect it and comply with the Privacy Act 1988 (Cth) and any other privacy laws that apply to you.

7. Our Relationship

You’re an independent affiliate. This Agreement doesn’t make you our employee, partner, agent or joint venturer, and you can’t make promises or commitments on our behalf. You’re free to promote other businesses too.

8. Third-Party Tools (Including Trello + GoHighLevel)

Some of our products include access to, or recommendations for, third-party tools such as Trello or GoHighLevel, and our affiliate program itself runs on a third-party platform. We aren’t responsible for issues arising from the use, misuse, deletion or misinterpretation of third-party tools. Please don’t make guarantees about those tools, and customers should always read their terms of service.

9. Ending Things (Let’s Not Get Here, But Just in Case)

You can leave the program at any time by emailing [email protected].

We may end your affiliate status at any time, for any reason, including unethical behaviour, spamming, misuse of your link or a breach of this Agreement.

Once things end, your link is switched off and you won’t earn new commissions. We’ll still pay commissions on genuine sales made before that date (less any refunds), unless we ended things because you breached this Agreement, in which case unpaid commissions may be forfeited.

10. Disclaimer + Limitation of Liability

We make no promises about how much you’ll earn. That depends on your own efforts and audience, and results vary. To the extent allowed by law, we aren’t liable for any indirect, special or consequential loss arising from your participation in the program. Nothing in this Agreement excludes any rights you have under the Australian Consumer Law that can’t be excluded.

11. Changes to This Agreement

We may update this Agreement from time to time. We’ll change the “Last updated” date above and email active affiliates about any significant changes. If you keep promoting us after an update, you’re agreeing to the new version.

12. Let’s Stay Legal (Governing Law)

This Agreement is governed by the laws of Queensland, Australia, and any disputes will be handled under Australian jurisdiction.

13. The Vibe (But Also Serious)

We’re here to do good work in the world, and that means building a community on kindness, honesty and integrity. We ask the same of our affiliates. When in doubt, choose the high road (with a dash of sparkle).

14. The Whole Agreement

This Agreement, together with our Terms & Conditions and Privacy Policy, is the full agreement between us about the affiliate program (no sneaky extras on the side). Any other changes only count if we agree to them in writing.
